NEGLIGENCE

-With any type of sport activity, the participant knowingly assumes the risk of injury that would come as a result of ORDINARY NEGLIGENCE, which protects the facility manager from such torts.  If there was some type of GROSS NEGLIGENCE on the part of the faclilty manager, than there would have been a breach of duty towards the user on the part of the facility manager.  An example of GROSS NEGLIGENCE would be instead of having protective mats on the floor, the facility placed a metal panel.
